Villa Santi properties are sold under the simplest and most popular form of land ownership, a registered leasehold. Under Thai law, leasehold is a very secure way of ownership for foreigners, with rights and obligations for both lessor and lessee clearly defined in the lease agreement

Leasehold property ownership in Thailand

The apartments and villas are sold with a 30-year leasehold on the land, which is renewable twice for a total of 90 years of leasehold ownership. The developing company owns the land

There are a number of benefits to owning leasehold title:

  • Owners’ names appear on the lease agreement and land title.
  • Owners retain full control of the sale of the lease or sub-lease without requiring approval from the lessor.
  • There is no need to find Thai shareholders or to establish a Thai company.
  • There are no annual audits and accounting fees that would be required if a Thai company is used.

Leased property can be sold or passed on at any time within the 90 year period. The purchase price includes prepayment of the full 90 years’ lease.

Condominium property ownership in Thailand

The condominiums are sold with condominium title and thus can be owned freehold (lifelong ownership), either directly in a foreigner’s name or through a Thai company. There is a special law in Thailand that allows foreigners to own condominium units under a freehold ownership. This freehold applies to the land as well.
